At 11:30 am Friday, February 15th, the Honorable Dean Lum ruled in favor of CNW and the City of Woodinville against Phoenix in their appeal of the City Council vote against the re-zone. Judge Lum ruled that the City had authority to deny the requested rezone. Attorneys Rick Aramburu for CNW and Greg Rubstello for the City made outstanding and incisive arguments in court and in their written briefs. You may view the briefs on our Documents page.
The written ruling will be issued February 29. Phoenix has thirty days to appeal this ruling to the Appeals Court; further legal activity is still a possibility.
Thanks to all the CNW members who attended the hearing. We filled up our side of the courtroom, and the Judge expressed his appreciation of our interest.
