Neighbors-

What a hearing process! Thank you to the many neighbors who came and stayed for the many hours of testimony. On one night the testimony ran past midnight.

You can be very proud of the CNW leaders that made compelling oral testimony and assembled a three volume submission with very technical arguments against the plat and up-zone. Imagine three giant 4” three-ring binders with contents that were truly remarkable. The thud factor of the submission was inspiring. I was humbled to see the quality and volume of work that a core of highly qualified neighbors prepared. A follow-up volume was submitted as a rebuttal to the opposition’s arguments. The hours of labor our neighbors have donated on our behalf are extraordinary. Our attorney also made excellent comments, was masterful with his cross-examination of the city, and submitted an outstanding evidence summary.

Because so many neighbors were willing to comment, the two-night hearing was extended to three nights.

The hearing examiner commented that he had never presided over such a hearing and was impressed by the amount and quality of comments. That is something considering he was the hearing examiner for Sea-Tac’s third runway. The opposition’s attorney commented to me that although he obviously disagreed with our findings he was very impressed on such a well organized effort and he had never seen a neighborhood group come together like that before.

We are still waiting for the hearing examiner to render his recommendation on the up-zone and the plat design to the city council. This is likely to happen this month. The city council will then have a public hearing and make a decision. Although they are not bound by the hearing examiners recommendation, it will carry strong weight. This will be a must attend night whenever it happens.

Because the hearings ran three nights and very late into the evening we incurred legal costs and could use your financial help at this time. The prep work, CNW conference calls, document review, etc. have been very successful and we need your financial help to continue the effort.

Also, at the city council meeting on May 7th, there will be a public hearing on the Sustainable Development Report Update/Approval of Work Plan and Budget. The city will receive public testimony regarding ordinance 431, the Hilltop Right-of-Way Vacation
