Times have been relatively quiet in our battle against Phoenix’s proposed development. Recall that through our efforts and those of the City Council, Phoenix was denied their request for a re-zone and their challenge in King County Superior court was denied when Judge Lum held that the City of Woodinville acted legally in making their decision.
The latest chapter in the story concerns the monetary damage claim that Phoenix was pressing against the City. This claim was tied to the Superior court suit they filed. Simply put, Phoenix felt they were entitled to monetary damages because they could not develop to R-4 density. Because Judge Lum ruled that Phoenix had no right to an up-zone, Phoenix’s argument to collect damages was severely weakened.
Phoenix moved to have the damages claim dismissed, and the City granted this request. Just so you know, CNW is not part of the damages claim, so our funds are not at risk. However, with this portion of the suit resolved for the time being, Phoenix has filed their appeal to the Court of Appeals sooner (August 13) than we previously expected. Phoenix will be submitting their brief in November, we expect, after which our and the City’s lawyers will respond.
