Hello CNW Neighbors!

We are in the Appeals Court stage of our battle with Phoenix Development, and we need your financial support.

Yes, the City Council supported our recommendation to deny the re-zone, and the Superior Court upheld their decision.  Yet we anticipated that Phoenix would appeal that decision to the Appeals Court, and here we are. Phoenix has filed their brief, and our side (Rick Aramburu representing us and Greg Rubstello representing the City, along with the legal counsel from the City’s insurers) are preparing the respondants brief.  We expect that after our brief is filed, Phoenix will prepare their rebuttal. We expect the case to be heard in court in Spring-Summer 2009.

We imagine you have questions regarding the ongoing situation, so here are some questions we have heard and responses:

Why is CNW still engaged in this matter? Isn’t this is the City’s hands now?

CNW’s technical and legal testimony was critical to Superior Court Judge Lum finding in our and the City’s favor so quickly.  Recall that the City staff who were in charge of the technical studies provided NO technical basis to deny the re-zone, and relied only on the “need” argument.  CNW remains a Party of Record, so we need to remain in the case to represent your interests. Moreover, our attorney Rick Arambaru has been a key member of the legal team that has successfully brought us this far. Phoenix continues to raise technical issues in their brief, and Rick has led the effort in defending the technical merits of our case, in matters such as slope stability and traffic safety. Finally, Rick’s legal credentials are important in the eyes of the Appeals Court Justices, giving us more credibility. Rick and Greg have agreed to share the responsibilities, so CNW is covering just part of the legal bills.

If we prevail in the Appeals Court, Phoenix could still choose to pursue the matter in the Washington Supreme Court. The City has also informed us, that even in this real estate market downturn, they have still received a number of inquiries about a re-zone of the R-1 area. If we don’t step forward to manage our growth, then growth will be given to us in ways we may not like.

 

How can I help?

You are our best advocates. If some one you know is interested and not receiving emails or aware of our web site, then please forward their email address to us and direct them to our web site. For those of you who live in Snohomish County, you can also help by sharing with your County officials our interest in protecting the golf course and the surrounding areas.

 

How did the meeting with City Manager Rich Leahy go?

Very well. Rich offered, as much as he could, information on the City’s legal efforts on the residential development issues. We were also able to share with him some of the history of the proposed developments. Further, he presented budgets and potential construction projects in the City, such as widening Woodinville-Duvall Road to 3 lanes east to the City limits (Slideshow 15 Mb!).  Note that the City is keeping property taxes at their current levels, and is being careful to manage its budget in times of reduced sales tax revenues.
