However, the anticipated legal retaliation by Phoenix has begun. We need long-term financial support to continue the fight. Simply put, if you don't want Phoenix to overturn the City's decisions regarding Wood Trails and Montevallo then send your check now to:
We are proud of City Council's decisions in August to deny the Wood Trails and Montevallo re-zone applications. But this does not stop here.
The good news is Phoenix and other developers are now on the defensive. The bad news is battles cost money. Although City Council voted in our favor, we knew the real fight would be in the courts after the decision. We prepared for this eventuality with a strong approach and supporting documentation. CNW's attorney prepared persuasive written briefs and oral arguments. Now our preparation is being put to the test.
Phoenix has taken two legal actions against the City of Woodinville:
Growth Management Hearings Board: This case concerns future zoning decisions in low-density residential areas. The Board requested additional briefs from both the City and the complainants Phoenix and Peter Rothschild. CNW can present information to the Board. If heard the final decision is due November 5th, 2007.
Land Use Planning Act (LUPA) Appeal: This case attempts to overturn the Council's decisions to deny the re-zone and plats for the Wood Trails and Montevallo developments.. Phoenix named CNW but we have no financial responsibility. This will be a lengthy process beginning February 2008 in King County Superior Court.
CNW is participating in both cases to assure Wood Trails and Montevallo never, ever, get built. We are well-positioned to withstand the appeals and win the war. The CNW leadership and many of our members are committed to seeing this through. However, this will take further funding. Please mail your check now.
A recent Weekly article confirming our concerns incorrectly stated CNW, along with the City, is being sued for $5 million in damages. CNW will not be financially liable in the unlikely event that Phoenix prevails in court. The article may be found at here
At the last moment Phoenix's attorney has handed only one copy of a 360-page "brief" to the Planning Commission wherein Phoenix asserts R-7 is the correct density for our area. They state R-7 is better for the environment than R-1. This is being reviewed by the City attorney but should receive attention.
CNW received the positive outcome we deserved but now it is time to pay the bill.
If you have not sent in $250 or more in the past year, please do so today. Your contribution records are kept confidential. 98% of our funds go to covering legal expenses, and 2% for printing and supplies. No money is given to any of our members.
Remember: if Wood Trails and Montevallo are built you may be forced to hook up to sewer at a cost of $10,000 to $30,000 per household. Consider paying a portion of this cost to defend your property value and your quality of life.
